GTC

These GTC govern the use of Photo Express and the purchase of digital document photos and photo prints offered through it. The sole contracting party and operator is Visible Solutions AG.

The German version of these GTC is legally binding. Translations are provided for information only. If there is any discrepancy or question of interpretation, the German version prevails.

1. Scope and operator

1.1 These GTC apply to the Photo Express website and online service (together, the "Service") and to all contracts concluded through it.

1.2 The operator is:

1.3 Terms submitted by customers apply only if Visible Solutions AG has expressly accepted them in text form. Individual agreements take precedence over these GTC.

1.4 Mandatory statutory consumer rights remain reserved.

2. Scope of the Service

2.1 Photo Express helps customers capture, automatically check, process and format portrait photos for the selected document. Depending on the offer, the result may be downloaded as a digital file or ordered as photo prints for delivery to an address in Switzerland.

2.2 The service description, selected format, price and delivery option shown before the order is placed define the contractual scope. Features or services not expressly promised are not owed.

2.3 Photo Express is not a public authority and is neither affiliated with nor commissioned by any issuing authority. Automated checks cover common quality criteria but do not replace an authority's assessment. The competent authority or other recipient alone makes the final acceptance decision.

2.4 Document-photo requirements may change at any time. Unless expressly promised otherwise, Visible Solutions AG does not guarantee that displayed requirements are complete or permanently up to date, or that a photo will be accepted for a particular purpose.

3. Formation of the contract

3.1 The display of services and prices is an invitation to place an order, not a binding offer.

3.2 Before placing an order, the customer can review and correct the selection and entries. By activating the button clearly marked as creating a payment obligation, the customer places a binding order and accepts the version of these GTC displayed during checkout.

3.3 The contract is formed when Visible Solutions AG electronically confirms the order, confirms payment or provides the ordered service, whichever occurs first.

3.4 Visible Solutions AG may reject an order before accepting it. It may also cancel an order in the event of an obvious pricing or system error, reasonable suspicion of misuse or fraud, or a legal or technical impediment. Payments already received will then be refunded; further claims exist only where required by mandatory law.

4. Customer obligations

4.1 Orders may be placed only by persons with legal capacity or with the consent of a legal representative.

4.2 In particular, the customer is responsible for:

  • selecting the correct country, document and photo format and confirming before ordering that the competent body accepts a customer-supplied photo;
  • providing correct and complete contact, payment and delivery information;
  • following the capture instructions and providing a suitable device, a supported browser, camera access and a sufficiently stable internet connection;
  • submitting only photos that may be captured and processed with the depicted person's consent and, for minors or persons lacking capacity, having the required authority to act; and
  • not using the Service unlawfully, abusively or in a manner that endangers security.

4.3 Prohibited conduct includes automated bulk requests, circumventing safeguards, interfering with the Service, reverse engineering to the extent it may lawfully be prohibited, and uploading unlawful content or content that infringes third-party rights.

5. Prices and payment

5.1 The total price displayed in the selected currency immediately before the order is placed applies. Applicable taxes, delivery charges and any other mandatory surcharges are shown before the order is placed.

5.2 The purchase price is due when the contract is formed. Charges and any refunds are processed through the payment method offered at checkout. The customer bears any fees or exchange-rate differences charged by their card issuer or payment institution.

5.3 Visible Solutions AG may withhold provision, download or dispatch until payment has been received in full.

6. Digital delivery and photo prints

6.1 Digital photos are made available for download after successful payment. The customer must download, check and independently back up the file promptly after it becomes available.

6.2 Photo prints are dispatched only to delivery locations supported in the checkout process. Delivery times are estimates unless a date has expressly been confirmed as binding.

6.3 The customer bears the consequences of incorrect or incomplete delivery information. The cost of a further delivery attempt may be charged if the failed delivery is attributable to the customer.

6.4 If performance becomes permanently impossible or an ordered delivery option is unavailable, Visible Solutions AG may withdraw from the affected part of the contract and refund the amount paid for it.

7. Voluntary refund for rejection by an authority

7.1 If an authority demonstrably rejects the unmodified photo created with Photo Express solely because of a photo-quality defect attributable to Photo Express, Visible Solutions AG will voluntarily refund the amount paid for the affected order.

7.2 The refund request must be submitted within 60 days after purchase exclusively through the refund form on the website. Other submission methods, including email, do not establish a claim under this voluntary refund. The form must contain complete order details and the specific reason for rejection. Visible Solutions AG may request the unmodified result, credible evidence from the authority and other information reasonably required to assess the request.

7.3 No refund is available if the rejection is based in particular on:

  • selection of the wrong country, document, format or intended use;
  • changed official requirements or requirements not represented in the Service;
  • the competent body's refusal to accept customer-supplied photos;
  • modification, compression, cropping, scaling or incorrect printing after download;
  • incorrect information or failure to follow capture instructions; or
  • a reason unrelated to objective photo quality.

7.4 The voluntary refund is normally made through the original payment method. Mandatory statutory remedies for defects remain unaffected.

8. Defects

8.1 A defect must be reported without undue delay after discovery, together with the order details and a comprehensible description. Visible transport or printing damage to photo prints should be documented with photographs where possible.

8.2 To the extent permitted by law, Visible Solutions AG first has the right to remedy the defect, at its option, by reprocessing, making the file available again or providing a replacement. If the remedy fails or is unreasonable, the statutory rights to a price reduction or refund apply.

8.3 No defect claim exists for deviations caused by subsequent editing, unsuitable print settings or materials, incorrect selection or information, incompatible customer systems, or other circumstances within the customer's responsibility.

9. Cancellation, returns and withdrawal

9.1 Swiss law does not provide a general right of withdrawal for online purchases. Photo Express does not grant a voluntary right of withdrawal or return.

9.2 Because digital photos and photo prints are created individually according to customer specifications, an order may no longer be cancelled after processing or production has begun or after the download has been made available, and may not be returned merely because the customer does not like it.

9.3 Any mandatory rights of withdrawal, warranty or refund under law that applies mandatorily to the customer remain reserved.

10. Rights in photos and the Service

10.1 The customer retains the rights they hold in the submitted and completed photo. The customer grants Visible Solutions AG, for the duration of the contract, the rights of use necessary to provide the Service, perform quality assurance and troubleshooting, maintain security and comply with legal obligations.

10.2 The completed photo may be used and reproduced for the depicted person's lawful private and professional purposes.

10.3 All rights in the Service, software, design, trademarks, text and other content provided by Visible Solutions AG remain with Visible Solutions AG or its rights holders. Any further reproduction, publication, exploitation or distribution is prohibited without prior consent.

11. Data protection

11.1 Visible Solutions AG processes personal data in accordance with the privacy policy available when the Service is used. If the customer is not the depicted person, the customer is responsible for providing any required information and obtaining any required consent from that person.

12. Availability, changes and force majeure

12.1 Visible Solutions AG aims to provide reliable availability but does not owe uninterrupted, error-free operation or compatibility with every device. Maintenance, security measures and technical faults may temporarily restrict the Service.

12.2 Visible Solutions AG may change or discontinue features provided this does not materially impair a main service already paid for. Otherwise, an equivalent service will be offered or the amount attributable to the unperformed part will be refunded.

12.3 Visible Solutions AG is not liable for delays or failures outside its reasonable control, including natural events, government measures, failures of communications or energy infrastructure, industrial disputes, war, epidemics or cyberattacks despite appropriate safeguards. Mandatory rights remain reserved.

13. Suspension and termination

13.1 Visible Solutions AG may temporarily block access or terminate an order if there are concrete indications of unlawful, fraudulent or security-threatening use, or if the customer breaches material obligations. Where reasonable, the customer will first be given an opportunity to remedy the breach. Amounts already paid are refunded only to the extent the corresponding service was not provided and the customer is not responsible for the reason for termination, or where mandatory law requires a refund.

14. Liability

14.1 Visible Solutions AG has unlimited liability for damage caused intentionally or through gross negligence and whenever liability may not legally be excluded or limited.

14.2 In the event of slight negligence, and to the extent permitted by law, Visible Solutions AG is liable only for breach of a material contractual obligation and only for foreseeable, direct loss typical of the contract. This liability is limited to the amount paid for the affected order.

14.3 To the extent permitted by law, liability for indirect or consequential loss, lost profit, lost savings, loss of data and third-party claims is excluded.

14.4 In particular, Visible Solutions AG is not liable for rejection or loss caused by official decisions, changed requirements, incorrect format selection, subsequent image editing, external printing, unsuitable devices or connections, incorrect customer data or other circumstances outside its responsibility.

14.5 The customer is liable under applicable law for culpable breaches of these GTC or third-party rights and, to the extent legally permissible, will indemnify Visible Solutions AG against resulting justified third-party claims and reasonable legal costs.

15. Changes to these GTC

15.1 Visible Solutions AG may amend these GTC for future orders. An order is governed by the version incorporated when it is placed. Changes to an existing contract require both parties' consent unless required by law or exclusively beneficial to the customer.

16. Final provisions

16.1 If any provision of these GTC is wholly or partly invalid, the remaining provisions remain effective. The invalid provision is replaced by the applicable law.

16.2 Substantive Swiss law applies exclusively, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Mandatory protections of the country in which a consumer habitually resides remain reserved.

16.3 For business customers, Zurich, Switzerland, is the exclusive place of jurisdiction. Mandatory statutory venues apply to consumers.
